How it works

Long-term gains, on assets held more than a year, are taxed at 0%, 15% or 20%, depending on where they fall on top of your other taxable income. For 2026 the 0% rate covers taxable income up to $49,450 single or $98,900 joint, and 20% starts above $545,500 and $613,700.

Short-term gains are taxed as ordinary income. Above $200,000 of MAGI single ($250,000 joint), the 3.8% net investment income tax applies as well.

2026 figures: IRS Rev. Proc. 2025-32 (2026 inflation adjustments).

Questions

Which states don't tax capital gains?

Alaska, Florida, Nevada, New Hampshire, South Dakota, Tennessee, Texas and Wyoming. Missouri exempts capital gains from its income tax, and Washington taxes only large long-term gains.
